Manatt Employment and Labor Leader Esra Hudson was quoted in Law360 about two ongoing efforts to modify California’s Private Attorneys General Act (PAGA).
The state’s governor has proposed a legislative fix to PAGA, which would be a compromise for both employers and employees. There is also a proposed ballot measure that would repeal PAGA, however repealing PAGA "would be a very big deal," according to Hudson. While this would not be the immediate end of PAGA lawsuits, "The way that the proposition is currently drafted, there will probably be some litigation over its effect on current PAGA cases," she said. "But yes, it should have a sweeping effect on PAGA."
