Manatt Antitrust and Competition Partner Dylan Carson was quoted in Fund Fire on the federal government’s increased antitrust enforcement activity.  

According to the article, federal regulators are increasing the amount of second requests to review information on deals and mergers, but this increased enforcement has yet to negatively impact transactions, with only a small percentage of deals receiving a second request. Managers should still be wary of upcoming investigations in a variety of undue industry concentrations, but Carson has not noticed any deceleration in the deal flow since the private equity funding sector has been under additional examination.   

With the upcoming presidential election, dealmakers should expect more antitrust probes since, "Now is the antitrust enforcers' opportunity to show that they are being aggressive and getting results," he said. "This may be their last opportunity to fulfill the 2021 executive order's mandate."
