In the article, Krasovec noted that for carriers, these types of decisions raise questions about how they determine the recipient of a call, how these recipients use their cellphone, the role of the applicable state law that governs protections, as well as how those protections can be enforced for cellphones that are crossing state lines. “There have been a lot of changes at the state level and there has been a lot of increase in state law claims as a result. Many of these laws were enacted or amended to address the contraction of the TCPA's application,” she said.
