Edelstein Quoted in Corporate Counsel on FTC Fake Review Rule

Marketers Mostly Pleased With FTC Plan to Clean Up High-Stakes World of Online Reviews

Manatt Advertising, Marketing and Media Partner Jeffrey Edelstein was quoted in Corporate Counsel on the Federal Trade Commission’s (FTC) recently proposed rule targeting fake online reviews, offering advice to marketers on how to remain compliant and avoid enforcement actions.  

Edelstein noted that companies and marketers are concerned about potential liability in light of the FTC’s proposed rule. He advised companies to monitor their systems for collecting and managing consumer reviews, stating, “I have recommended that marketers ensure that they are in compliance with the proposed rule, even though it is not yet in effect. The FTC is likely to issue the rule in substantially similar form after the rulemaking process has concluded.” He also suggested that companies monitor for potentially deceptive advertising for third parties they hire, as “the advertiser would most likely be held liable by the FTC along with the third party.”
