Intellectual property protection and enforcement partner Irah Donner wrote an article for Intellectual Property & Technology Law Journal on two notable trade dress decisions recently issued by the U.S. Court of Appeals for the Seventh Circuit and the U.S. Court of Appeals for the Fourth Circuit, respectively. In the article, Donner analyzed why a conveyor belt fastener’s “beveled center scallop” design was not entitled to trade dress protection following the Seventh Circuit’s recent ruling in Flexible Steel Lacing Co. v. Conveyor Accessories Inc. He also discussed the Fourth Circuit’s decision in CTB Inc. v. Hog Slat, Inc., which clarified the limits of trade dress protection/infringement in relation to a chicken feeder design.
