“2011 Seen as Year of Follow-up, Follow-Through for Life Sciences”
BNA's Life Sciences Law & Industry Report

January 14, 2011 - Manatt professionals were featured in BNA's Life Sciences Law & Industry Report’s preview of the most significant issues facing the life sciences industry in 2011.  Manatt partner Wendy L. Krasner, senior advisor Ian Spatz, and associate William Connelly weighed in on topics expected to be closely monitored by the industry, including the ongoing impact of federal healthcare reform and regulations promulgated by the Centers for Medicare and Medicaid Services (CMS), as well as upcoming proposed regulations to cover accountable care organizations.

Concerning the requirement for clinical trial sponsors to report to CMS, Connelly said, "to the extent that clinical trial sponsors pay for complications or injuries that result from clinical trials, they will be subject to the same burdensome reporting requirements as insurance companies that offer liability insurance.  Mandatory reporting began on Jan. 1, 2011, but reporting is required for payments made on or after Jan. 1, 2010."
