    January 1, 2011 - Ivan J. Wasserman, a partner in Manatt’s Advertising, Marketing and Media Division, provided insight to InsideCounsel on regulators’ increasingly aggressive stance when it comes to prosecuting deceptive advertising claims.

    InsideCounsel identifies the U.S. Federal Trade Commission’s recent appellate victory in FTC v. Direct Marketing Concepts as being indicative of a trend at both the state and national levels. In that case, the government prosecuted not only the businesses that made the deceptive ads, but also business partners and company leaders.

    The government’s approach, Wasserman said, should remind people that the corporate structure won’t necessarily shield them from being held directly responsible for false advertising - a prosecution tactic increasingly popular in these cases.

    "Going after individuals is going to be a more and more common occurrence," Wasserman told InsideCounsel.
